Discovery Set Voucher Terms and Conditions

These Terms ("Terms") govern the promotional voucher of $45.00 in United States dollars (the "Voucher") that Musk de Lumière ("Musk de Lumière," "we," "us," or "our") offers with the purchase of a qualifying Discovery Set at muskdelumiere.com (the "Site"). They form a binding agreement between you and Musk de Lumière. By purchasing a Discovery Set, by receiving a Voucher, or by redeeming a Voucher, you confirm that you have read, understood, and agreed to these Terms. Please read them carefully and keep a copy for your records.

1. Definitions

"Discovery Set" means a qualifying Discovery Set product offered for sale by Musk de Lumière on the Site. "Eligible Product" means a single 50 ml eau de parfum from the L'Arbre de Vie collection offered on the Site and designated by us as eligible for Voucher redemption. "Voucher" means the single use promotional discount code worth $45.00 (USD) issued under this offer. "Holder" means the person entitled to redeem a Voucher under Section 10. "Issuance Date" means the date on which we send the unique code by email. Headings are for convenience only and do not affect interpretation.

2. The offer

When you purchase a qualifying Discovery Set on the Site, you become entitled to one Voucher worth $45.00 (USD) to apply toward the purchase of one Eligible Product on the Site. The Voucher is issued as a unique discount code that functions one time only. The offer is a limited promotional offer. We may change, limit, or end it as set out in Section 16.

3. How and when you receive your code

We send your unique code by email on the day your Discovery Set order is marked delivered, to the email address associated with your order. You are not required to subscribe to our marketing email to receive your code. Delivery depends on the accuracy of the email address provided and on factors outside our control, including spam filtering and mailbox availability. If you do not see the email, please check your spam and promotions folders, then contact us. We are not responsible for codes that fail to reach an inaccurate, misspelled, full, or disabled mailbox.

4. Nature of the Voucher

The Voucher is a promotional discount offered at no separate charge. It is not a gift card, gift certificate, stored value product, prepaid instrument, account credit, or security, and it is not money. It is not redeemable or exchangeable for cash, and no cash or store credit is given for any unused portion. The Voucher is issued for promotional purposes only, was not purchased by you for value, and is not reloadable. To the maximum extent permitted by law, gift card and stored value statutes do not apply to the Voucher.

5. Value and eligible products

A Voucher entitles the Holder to $45.00 (USD) off the listed price of one Eligible Product on the Site. The Voucher applies to Eligible Products only. It does not apply to Discovery Sets, sample or travel sizes, gift cards, bundles other than as stated, shipping, duties, or taxes, or to any product we have not designated as an Eligible Product. If the price of the Eligible Product is greater than $45.00, you pay the difference. If the price is less than or equal to $45.00, the Voucher reduces the eligible item to no less than zero, and no balance, change, credit, or refund is given for any difference.

6. Validity period and expiry

The Voucher is valid for thirty calendar days from the Issuance Date. It expires automatically at the end of that period, after which it cannot be redeemed and has no value. We may send courtesy reminders before expiry, but sending or receiving a reminder is not a condition of expiry, and it is your responsibility to redeem the Voucher before it expires. Expired Vouchers are not reissued, extended, replaced, or honored except at our sole discretion.

7. One per order, one per customer, one per household

The offer is limited to one Voucher per qualifying Discovery Set order. Each code is unique and functions one time only. The offer is intended for personal use by one customer and household and is limited to one redeemed Voucher per customer, per household, per payment method, and per shipping address, except where we choose to allow more. We may treat multiple orders or accounts that appear to be controlled by the same person or household as a single customer for the purpose of this limit.

8. No combination with other offers

The Voucher cannot be combined with any other discount code, voucher, coupon, credit, or promotional offer on the same order. Standard inclusions that are not promotional codes, such as complimentary shipping where offered and the complimentary 2.5 ml sample offered with full bottles, continue to apply. Only one promotional code may be applied per order.

9. Eligibility

To purchase a Discovery Set or redeem a Voucher you must be at least eighteen years old, or the age of majority in your place of residence if greater, and able to form a binding contract. The offer is available only for orders shipped to a valid United States shipping address. The offer is void where prohibited, restricted, or taxed in a manner that would make it unlawful.

10. Who may redeem; not transferable; no resale

A Voucher may be redeemed only by the customer who purchased the qualifying Discovery Set and received the unique code directly from us, or by a person with whom that customer has shared the code as a gift under Section 11. The Voucher is personal to the Holder. Except for a gift shared under Section 11, it may not be sold, auctioned, bartered, transferred, assigned, or offered for value, and it may not be used for any commercial, promotional, or resale purpose. Any Voucher obtained from a source other than a direct email from Musk de Lumière or a gift from the purchaser under Section 11, or used in breach of this Section, is void.

11. Gifts

Vouchers are issued to the purchaser. A Voucher code is not locked to an account and may be shared by the purchaser with another person as a gift; whoever redeems the code uses its single redemption. We no longer collect gift recipient details at checkout, and we do not send Voucher codes to third parties on your behalf. One code is issued per qualifying order, whether or not the set is given as a gift. If you share your code, you do so at your own discretion; a code that has been redeemed is treated as used and is not reissued or replaced.

12. Where it can be redeemed

The Voucher is redeemable only at checkout on muskdelumiere.com. It cannot be redeemed through any marketplace, reseller, retail partner, social platform, or any channel other than the Site. It cannot be applied to a past order or after checkout is complete.

13. Taxes, shipping, and currency

The Voucher is applied to the price of the Eligible Product before shipping and tax. Any sales or other tax is calculated on the price actually paid after the discount, to the extent required by law, and is your responsibility along with any applicable shipping charge. All amounts are stated in United States dollars.

14. Returns, cancellations, and refunds

A Discovery Set purchased in connection with this offer may not be returned or refunded once the associated Voucher has been redeemed. A Discovery Set whose Voucher has not been redeemed remains subject to our standard return policy. If you return an Eligible Product that you purchased using a Voucher, any refund is limited to the amount you actually paid for that item after the discount, and the Voucher itself has no cash value, is treated as used, and is not refunded, reinstated, or reissued. We may decline a return or adjust a refund to recover the value of a Voucher used in a manner these Terms do not intend.

15. Fraud, abuse, and right to void

We may, at any time and in our sole discretion, refuse, suspend, void, or cancel any Voucher, order, or account, and withhold or reverse any discount, where we reasonably suspect fraud, tampering, manipulation, bulk or automated generation, resale, breach of these Terms, or any attempt to obtain or use a Voucher in a way this offer does not intend. Vouchers are void if copied, sold, transferred other than as a gift under Section 11, or obtained through error, manipulation, or unauthorized means.

16. Changes to or termination of the offer

We reserve the right to modify, suspend, or terminate this offer or these Terms at any time and for any reason, with or without notice. Changes take effect when posted on this page, identified by the "Last updated" date above. Vouchers already issued before a change will be honored under the Terms in effect on their Issuance Date, except that we may void any Voucher at any time for fraud, abuse, breach, or legal reasons under Section 15.

17. Disclaimer of warranties

The offer and the Voucher are provided on an "as is" and "as available" basis, without warranty of any kind, whether express, implied, or statutory, to the fullest extent permitted by law. Without limiting the foregoing, we do not warrant that the offer will be uninterrupted or error free, that codes will be delivered without delay, or that the Site will be available at any particular time. This Section does not exclude any warranty or right that cannot be excluded under applicable law.

18. Limitation of liability

To the maximum extent permitted by law, in no event will Musk de Lumière, or its owners, officers, employees, agents, or suppliers, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, or opportunity, arising out of or relating to the offer, the Voucher, or these Terms, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the offer or any single Voucher will not exceed the face value of that Voucher, namely $45.00 (USD). Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, and nothing limits your statutory rights as a consumer.

19. Indemnification

You agree to indemnify and hold harmless Musk de Lumière and its owners, officers, employees, and agents from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your misuse of a Voucher, your breach of these Terms, or your violation of any law or the rights of a third party in connection with the offer.

20. Privacy

We use the order and email information needed to issue and administer your Voucher in accordance with our Privacy Policy.

21. Force majeure

We are not liable for any delay or failure in delivering or honoring a Voucher caused by events beyond our reasonable control, including acts of nature, outages, failures of carriers, payment processors, or email providers, labor disputes, or government action.

22. Governing law and venue

These Terms and any dispute arising out of or relating to them or the Voucher are governed by the laws of the State of New Jersey, United States, without regard to its conflict of laws rules. Subject to Section 23, you agree that the state and federal courts located in New Jersey have exclusive jurisdiction, and you consent to venue and personal jurisdiction there.

23. Dispute resolution and class action waiver

If you have a concern, please contact us first so we can try to resolve it informally; most matters can be settled quickly this way. You agree to attempt informal resolution in good faith for at least thirty days before starting any formal proceeding. To the fullest extent permitted by law, any dispute will be brought only in your individual capacity, and not as a plaintiff or class member in any class, collective, or representative action. This Section does not deprive you of any right to bring a matter before a small claims court or a government agency, where applicable.

24. General

These Terms, together with the policies they reference, are the entire agreement between you and Musk de Lumière regarding the offer and the Voucher, and they supersede any prior statement about it. Our failure to enforce any provision is not a waiver of it. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full effect. You may not assign or transfer your rights under these Terms; we may assign ours to an affiliate or successor. Sections that by their nature should survive, including Sections 17 through 24, survive expiry of the Voucher or termination of the offer.
