These Terms of Service (“Terms”) govern your use of and access to the Services, including any purchases made through our store. By accessing or using the Services, you agree to be bound by these Terms.

Brand Identity and Non-Affiliation Disclaimer

Musk de Lumière is an independent fragrance house dedicated to producing original, high-quality artistic perfumes. While certain fragrances in our collection may be inspired by the scent profiles of well-known luxury perfumes, we are not affiliated with, endorsed by, connected to, or sponsored by any designer houses, fashion brands, or trademark holders.

All brand names, copyrights, and trademarks referenced remain the sole property of their respective owners. References to brand names are provided strictly for descriptive and comparative purposes only so customers can understand the inspiration behind a fragrance’s olfactory character.

Our perfumes are not replicas, dupes, or counterfeits. They are independent creations crafted with premium materials, artistry, and refinement. Many of our customers find that Musk de Lumière perfumes feel more natural, longer-lasting, and superior in quality compared to mainstream designer fragrances.

Eligibility and User Responsibilities

By using the Services, you confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction) and capable of entering into legally binding agreements. You agree that the information you provide to Musk de Lumière is accurate, complete, and up to date.

If you create an account, you are responsible for safeguarding your login credentials. Musk de Lumière is not responsible for unauthorized use of your account caused by your failure to maintain the confidentiality of your information.

Orders and Payments

All pricing for our products is listed in U.S. Dollars unless otherwise indicated. We reserve the right to change pricing at any time without prior notice.

Orders are subject to acceptance and availability. Musk de Lumière may refuse or cancel any order at its discretion, including if fraudulent or unauthorized activity is suspected.

Payments are processed securely by trusted third-party providers such as Shopify Payments. We do not store your full credit card or financial details on our servers.

Shipping and Delivery

Orders are processed in the order they are received. Shipping times are provided as estimates and may vary due to carrier delays, customs procedures, weather conditions, or other factors outside our control.

Once an order is shipped, the risk of loss and ownership transfers to the customer at the time the carrier confirms delivery. Musk de Lumière is not responsible for lost or stolen packages after delivery confirmation.

Returns and Refunds

Fragrance products are consumable and hygienic in nature. As such, Musk de Lumière does not accept returns or exchanges except in cases of products proven to be damaged during shipment. Please reference our Refund and Return Policy for full details regarding replacements and store credit.

Intellectual Property

All content on this website and within the Services — including but not limited to fragrance formulas, names, logos, product descriptions, photographs, videos, text, and designs — are the intellectual property of Musk de Lumière and are protected under applicable copyright, trademark, and intellectual property laws.

You agree not to copy, reproduce, modify, or distribute any Musk de Lumière content without our express written permission.

Limitation of Liability

Fragrance is a personal experience, and reactions may vary depending on individual body chemistry. Musk de Lumière cannot guarantee a specific result for every individual. By purchasing or using our products, you acknowledge and accept the risk of potential allergic reactions or sensitivities.

To the fullest extent permitted by law, Musk de Lumière is not liable for indirect, incidental, special, or consequential damages arising from the use of our products or Services. Our liability, if any, shall not exceed the purchase price of the product in question.

Intellectual Property

All content on this website and within our services—including, without limitation, fragrance names, original formulas and compositions, product descriptions, photographs, videos, text, page layouts, graphics, logos, and designs—is the exclusive property of Musk de Lumière or its licensors and is protected by applicable copyright, trademark, trade-dress, and other intellectual-property laws.

Except as expressly permitted in writing by Musk de Lumière, you may not copy, reproduce, modify, adapt, publicly display, publish, distribute, or create derivative works from any content on this site.

Third-Party References & Nominative Fair Use

From time to time we reference third-party brand names and/or fragrance titles These references are used solely for identification and comparison purposes under the doctrine commonly known as nominative fair use. Specifically:

  1. The referenced brand/fragrance is not reasonably identifiable without using its trademarked name;

  2. We use only so much of the mark as is reasonably necessary (i.e., the name itself, without logos, stylization, or trade dress); and

  3. Our usage does not suggest sponsorship, affiliation, endorsement, manufacturing, or licensing by the trademark owner.

All third-party trademarks, product names, and company names are the property of their respective owners. Musk de Lumière is not affiliated with, endorsed by, or sponsored by any of the referenced brands, and our products are not those brands’ products.

“Inspired by” / Comparative Statements

Our perfumes are independent creations. Any “inspired by,” “in the style of,” “if you like ___, you may enjoy ___,” or similar language is intended only to communicate the general olfactory family, mood, or consumer reference point for shoppers. It does not mean our fragrances are exact replicas, counterfeits, or sourced from those brands.

  • We do not claim exact olfactory duplication.

  • We do not use any third-party brand’s proprietary formula, trade secrets, or sourcing.

  • Our compositions are developed from legally obtained aroma chemicals, naturals, and accords, crafted by Musk de Lumière.

No Affiliation / No Counterfeiting

Musk de Lumière products are not manufactured by, licensed by, or in any way connected to the third-party brands we may reference. We do not reproduce or sell any third-party brand’s bottles, caps, labels, logos, or trade dress. Any similar descriptors refer to conventional industry concepts (e.g., “eau de parfum,” “extrait”) rather than any brand’s distinctive get-up.

Product Differentiation & Non-Equivalence

Each Musk de Lumière fragrance is its own formula and will vary in note structure, materials, concentrations, diffusion, and wear. Performance, naturalness, and character are subjective and can vary with skin chemistry and conditions. We expressly disclaim any promise of equivalence to any third-party fragrance.

Customer Reviews & User Content

If customers mention third-party brands in reviews or Q&A, such references are user-generated and reflect personal opinions. We reserve the right to moderate content that could imply affiliation or mislead consumers.

Takedown / Trademark Concern Procedure

If you are a rights holder and believe that any reference on our site is inaccurate or exceeds nominative fair use, please contact: legal@muskdelumiere.com with (a) proof of rights, (b) the specific URL(s), and (c) a description of the concern.
